kubario Terms of Service

These Terms of Service (the "Terms") set out the conditions for using "kubario", an SNS bulk-posting and management service provided by HOMUTA HOLDINGS INC. ("we", "us" or "our") (https://www.kubario.com, the "Service"). Please use the Service only after agreeing to these Terms.

Article 1 (Scope)

These Terms apply to all relationships between us and users concerning the use of the Service. The rules and guidelines that we post on the Service form part of these Terms.

Article 2 (Registration)

Use of the Service requires registration by the prescribed method. We may refuse registration if the applicant registers false information, has previously violated these Terms, or in any other case that we deem inappropriate.

Article 3 (External SNS integration)

The Service provides features that integrate with external SNS platforms such as Google / YouTube, X (formerly Twitter), Meta (Facebook / Instagram / Threads), TikTok, and LINE. When using these integrations, you must also comply with the terms of service and privacy policy of each SNS. Data obtained through external SNS integrations is used solely to provide the features of the Service.

The names and logos of external SNS displayed within the Service are the trademarks and similar rights of their respective providers. We use them, in accordance with the brand guidelines, trademark usage rules, and similar policies established by each provider, solely for the purpose of explaining the integration features.

The specifications, APIs, policies, and similar rules of external SNS platforms may be changed by their providers without prior notice. When such changes require us to modify or update the Service, there may be a period during which posting to, retrieving content from, or otherwise using integrations with the affected SNS is partially or wholly unavailable until our adaptation work is complete. By using the Service, you acknowledge and agree that such temporary limitations may occur.

Article 4 (Prohibited conduct)

Users must not engage in acts that violate laws or public order and morals, acts that infringe the rights of third parties, spam or nuisance activities, imposing an excessive load on the Service, unauthorized access, or similar acts.

Article 5 (Suspension of the Service, etc.)

We may suspend or change all or part of the provision of the Service without prior notice due to system maintenance or inspection, natural disasters, accidents, failures of external services, or similar reasons.

In addition, when specification changes of an external SNS require modifications to the Service, we may, without prior notice, temporarily suspend or restrict posting to that SNS and other integration features until such modifications are completed.

Article 6 (Disclaimer)

Except in cases of our willful misconduct or gross negligence, we shall bear no liability whatsoever for any damages incurred by users in connection with the Service. Nor are we liable for specification changes, failures, or API discontinuation of external SNS, or for any temporary inability to post, functional limitations, or delays in adapting the Service that result therefrom.

Article 7 (Changes to and termination of the Service)

We may change the contents of the Service, or terminate the provision of the Service, upon prior notice to users.

Article 8 (Changes to these Terms)

We may change these Terms as necessary. The revised Terms take effect upon being posted on the Service.

Article 9 (Governing law and jurisdiction)

These Terms shall be interpreted in accordance with the laws of Japan as the governing law. With respect to any dispute relating to the Service, the court having jurisdiction over the location of our head office shall be the court of exclusive agreed jurisdiction.
